Part 5: Instruction Contract Requirements
- Commercial driver training school contracts with individual students, public schools,
or private schools shall contain (but are not limited to) the following information:
- the agreed total contract charges and full terms of payment thereof;
- the number, nature, time and extent of lessons contracted for, including:
- classroom instruction:
- rate per hour;
- date and time of first lesson and each subsequent lesson, the length of each lesson,
and the total number of hours;
- type of instruction;
- a limit of fifty students and no more than three hours of classroom work per day
on school days and six hours per day on non-school days for unlicensed individuals
under the age of eighteen.
- behind-the-wheel instruction:
- rate per hour;
- date and time of first lesson and each subsequent lesson, the length of
each lesson, and the total number of hours;
- nature of lessons, whether individual or group. An instructor may not provide
behind-the-wheel training to more than three individual students.
- rate for use of school vehicle for a driver license road test, if an extra charge is made;
- a statement which reads substantially as follows: "This agreement constitutes the
entire contract between the school and the student, and any verbal assurances or
promises not contained herein shall bind neither the school nor the student."
- a statement which reads as follows: "This school is licensed by the State of North
Carolina, Division of Motor Vehicles."
- a statement which reads as follows: "Under this agreement an instructor may not
provide behind-the-wheel training to more than three individual students."
- If either the school or the instructor fails to comply with the provisions of any contract
or agreement between the school and the student, the school shall refund, on a pro rata
basis, all monies collected from the student as consideration for the performance of the
contract or the agreement.

Commercial driver training school contracts shall not contain the following:
- the statement "no refund" or its equivalent. The contract may, however, contain a statement that
"The school will not refund any tuition monies or any part thereof when actual services have been
rendered";
- any statement to the effect that a driver license is guaranteed or otherwise promised as a result
of the driver license training course.

The commercial driver training school shall file with the Division sample copies of all written
contracts and agreements at the time of the original application and also at any time thereafter
when alterations to contracts are proposed.

METHODS OF PAYMENT
 Payment for transactions at DMV Driver License Offices are limited to cash or personal checks drawn on a North Carolina bank or on out-of-state banks having a branch in North Carolina. No other forms of payment are accepted, including debit and credit cards.
