Titling Vehicles in a Trust
When a Trust is created, it is a separate legal entity, which is capable of owning property
through a Trustee. An Express Trust is a Trust which is created by a property executed
written instrument that outlines the terms and conditions of the Trust. Even though the
identity of the owner and the Trustee may be one and the same with regard to the Trust, they
are two separate entities. Thus, when property is transferred, the legal ownership has
changed.

If the Trust Agreement has several Trustees, all must sign the North Carolina Title Application (MVR-1)
In order to accept only one signature on the Title Application (MVR-1) the Trust must
specify if only one Trustee can sign for all Trustees. The Trustee of a Trust holds legal
title to property, which is held in Trust. Therefore, the Trustee is the legal owner of the
property and the title must show the name of the Trustee.
Vehicles titled in the name of an individual requesting a correction to the name of a Trust
are not acceptable.

To transfer a vehicle into the name of a Trust you will need the following:
- An assignment of the title
- Front and back page of the Trust to ensure that:
- Trust is valid.
- The Trustee is in fact authorized to act on behalf of the Trust.
- $40.00 Title Fee
- Highway Use Tax is based on computer value of the vehicle, unless sold by a dealer. Then a
bill of sale would be required.
- License Plate cannot be corrected to the Trust.
Note: A North Carolina Title issued in the name of a Trust or Trustee does not
require a copy of the front and back of the Trust when the vehicle is being sold. A research
of the records is required to verify that the Trust copies are on file and that the person
signing is authorized by the Trust.
