POSITIVE DRUG/ALCOHOL TEST
CHECK LIST TO SUBMIT FORMS TO DMV
In order for the Division of Motor Vehicles to enter a disqualification for a positive drug or alcohol test, the following information MUST be received. Failure to comply with these instructions will delay the required disqualification.
- Test date must be on or after December 1, 2005
- Employee must have a valid NC CDL or CDL Permit.
- Test must be performed as required under 49 CFR part 382 and 49 CFR part 655.
- Positive test results for pre-employment must be reported to the DMV.
- Refusal to submit to a Federal Drug/Alcohol test is considered a positive test result.
- The correct form must be completed and sent to DMV along with the Federal Testing Custody and Control Form signed by the Medical Review Officer.

- CDL-9 Refusal to submit to a Federal Drug/Alcohol Test.
- Drug/alcohol test results:
- Test results form must have the name and signature of the Medical Review Officer, not the certifying scientist.
- Test results form must have the date and reason for the test.
- Test results form must certify that the testing was done by Federal requirements and guidelines. (refer to #3)
- Alcohol test form must show a BAC of .04 or more before the disqualification can be entered.
- Alcohol test form must have the name and signature of the Breath Alcohol Technician.
- Faxed copies are allowed, however, the original copies must be sent to the Division to the address shown on form CDL-8 or CDL-9.
To end the disqualification, the Division must receive verification from a Substance Abuse Professional that the employee successfully completed the substance abuse assessment and any training or education that was required, NC GS 20-17.4(l).
NCDMV must disqualify a CDL Holder from operating a commercial motor vehicle for a minimum of 30 days and until receipt of proof of successful completion of assessment and treatment by a D.O.T. Substance Abuse Professional in accordance with 49 C.F.R. & 382.503.
