  • -shall solicit comments from appropriate environmental regulatory agencies regarding permitting, and/or monitoring requirements, for specific applications of certain recycled products or solid waste materials. The requesting agency, municipality or industry shall be responsible for obtaining all required permits if their material is approved to be used within Department right-of-way.

  • - may require the requesting agency, municipality, or industry to enter into a contractual agreement to indemnify the Department from potential claims arising from the usage of specific recycled products or solid waste materials within Department right-of-way.

  • - shall identify appropriate Department projects for using approved recycled products or solid waste materials. The Task Force shall maintain a record of the location and quantity and type of approved material used. The performance of the material shall be monitored periodically by the Task Force or as required by environmental regulatory agencies.
